Any advice given by Holland Holistic LLC or its contracted service providers is designed to assist users in making better decisions regarding the services we provide and not designed as professional medical advice. Any questions about personal health conditions or those seeking medical advice should see a medical professional. Service users assume full risk and responsibility for all services provided by Holland Holistic LLC and its contracted service providers. You agree to hold Holland Holistic LLC and its affiliates harmless from all claims, damages, causes of actions, judgments, liabilities, expenses and demands of any kind relating to your use of, your reliance upon, or errors or omissions in, information found on the services provided. As a user of the services provided, you agree Holland Holistic LLC will not be held liable to you or anyone else because of
any treatment you receive.
Holland Holistic LLC does not make any warranty or claims regarding your fitness following any services provided. In the event you are unfit to drive a vehicle, boat or operate machinery, you may need someone to accompany you until you can resume normal activities. Although Holland Holistic LLC does provide services for those suffering from excessive alcohol intake, we do not condone or support the use of such excessive intake and instead promote the act of responsible drinking. Please do not drink and drive under any circumstance.
Holland Holistic LLC and its contracted providers do not guarantee services to any individual who is deemed physically unable to consent for services or has any medical condition we deem could potentially be exacerbated or made worse through any treatment we provide. Holland Holistic LLC has the right to refuse treatment to anyone. In the event services are requested and booked through Holland Holistic LLC or its constituents and a provider upon arrival deems you unfit to consent to services, for any reason, you will be invoiced an additional $100.00 (one-hundred dollars) and no services will be provided. Any unpaid invoices will be sent to collections after 3 reminders and 30 days.
Indemnification
You agree to indemnify and hold harmless Holland Holistic LLC, its contractors, and their respective directors, officers, employees and agents from and against any and all claims, damages, causes of action, judgments, liabilities, demands and expenses of any kind or nature whatsoever, including attorneys’ fees, arising out of your use of the Services, including but not limited to, arising out of your violation of this Agreement.
Applicable Law and Jurisdiction
You agree that any suit, action or proceeding between you and Holland Holistic LLC in connection with or arising from this Agreement shall be governed by the law of the state of Hawaii for the services as such laws are applied to agreements between Admin State residents entered into and performed entirely within the state of Hawaii. You consent to the jurisdiction of federal and state courts within the state of Hawaii. You consent to the venue in any Judicial Action brought against you in connection with breaches of this Agreement. You consent to electronic service of process regarding any Judicial Action under this Agreement.
Confidentiality
Holland Holistic LLC acknowledges that it will be in possession of confidential health information (the “Confidential Information”) relating to the provision of the Services. Holland Holistic LLC shall hold all Confidential Information in strict confidence and shall not disclose any Confidential Information to any third party, other than to its employees, agents, consultants, subsidiaries, and other affiliates who (i) need to know such information, (ii) are informed of the existence of this Agreement and its restrictions on the disclosure and use of Confidential Information, and (iii) are bound by employment, consulting or similar agreements restricting the disclosure and use of such information comparable to and no less restrictive than those set forth herein. Holland Holistic LLC shall not use any Confidential Information for the benefit of itself or any third party or for any purpose other than for the provision of services. Holland Holistic LLC shall take the same degree of care that it uses to protect its own confidential and proprietary information and materials of similar nature and importance (but in no event less than reasonable care) to protect the confidentiality and avoid the unauthorized use, disclosure, publication or dissemination of the Confidential Information. Your health information may be used by staff members or disclosed to other health care professionals for evaluating your health prior to any services rendered. Your health information may be used to seek payment from your health plan or from credit card companies that you may use to pay for services. Your health information may be
disclosed to public health agencies as required by law. For example, we are required to report certain communicable diseases to the state’s public health department. When we report suspected elder or dependent adult abuse or domestic violence, we will inform you or your personal representative promptly unless in our best professional judgment. As required by law in certain circumstances other than public health reporting, your health information may be used and disclosed by our staff, but such use and disclosure will be limited to the relevant requirements of the law concerning such specific circumstances.
Your health information may be disclosed to law enforcement agencies, without your permission, to support government audits and inspections, to facilitate law-enforcement investigations, to comply with government mandated reporting and for other law enforcement purposes. In the event of a breach of unsecured protected health information, we will notify you as required by law.

Some activities, such as the scheduling of an appointment, require Holland Holistic LLC to collect personal identifying information. Clients Rights
The right to request restrictions on the use and disclosure of your protected health information by a written request specifying what information you want to limit, and what limitations on our use or disclosure of that information you wish to have imposed. We may not be required to agree to the restriction that you requested due to limitations contained in the applicable laws and we will notify you of our decision to reject your request;
The right to receive communications from us concerning your medical condition and treatment through reasonable, confidential alternative means selected by you;

We are not required to change your health information and will provide you with information regarding our denial of such requested amendment. If we deny your request, you may submit a written statement of your disagreement with that decision, and we may, in turn, prepare a written rebuttal;
The right to receive an accounting of how and to whom your protected health information has been disclosed; provided, however, we are not required to provide to you an accounting of disclosures made for the purposes of treatment, payment, health care operations, information provided directly to you, information provided pursuant to your written authorization, and certain government functions; and the right to receive a printed copy of this notice.
We are required by law to maintain the privacy of your protected health information and to provide you with this notice of privacy practices. We also are required to abide by the privacy policies and practices that are outlined in this notice.
Protected Health Information Requests
As permitted by federal regulation, we require that requests to inspect or copy protected health information be submitted in writing. You may obtain a form to request access to your records by contacting us by phone or email.
Complaints
If you would like to submit a comment or complaint about our privacy practices, you can do so by sending a letter outlining your concerns. You also have the right to submit a complaint to the Secretary of the Department of Health and Human Services if you believe your privacy rights have been violated.
